I. You do not have to talk directly with the IRS agent
Once you hire someone to handle your IRS problem, all you would have to do is sign a "Power of Attorney" then they will handle all the communications with the IRS for you. When you hire me, my office will communicate any developments directly to you. In turn you would be responsible for gathering all the proper documents, providing all the necessary information, and supporting paperwork the IRS is asking for so I can quickly move your case along.
II. What If You Haven't Filed A Tax Return In Years?
The good news is it's not too late, but don't keep ducking forever. Like they say, you can run but you can't hide! What I'm offering here is a way to help you get your life back on track as quickly as possible by helping you properly file the right forms. If you didn't already know, by law, you are required to file your tax returns (unless your income is below specified amounts).
The next thing is, if you plan on negotiating a tax settlement with the IRS you must file all your past tax returns. One of the most common causes for not qualifying for an IRS Tax Debt Payment program is unfiled tax returns. Once all the tax returns are filed we can start talking to the IRS about filing an "Offer in Compromise" (OIC) of the amount of tax owed or we can discuss making an "Installment Agreement," with the IRS or any other type of appropriate relief. But, as I said, first you are required to be current with all your tax filings and returns.
However, there's more you need to know. As a part of any tax debt settlement agreement that you make with the IRS, whether it's an Installment Agreement or "Offer in Compromise," you are required to remain compliant for the next five years. This means that you must file all your tax returns, and pay your taxes ON TIME!!! Failure to remain compliant voids your original agreement and the balance of the original tax debt then becomes due.
III. Can The IRS File A Lien On Your Property?
YES!!! I know your probably scared to death knowing what the IRS could do, however if you fail to pay your taxes the IRS can really put the pressure on by filing a Federal Tax Lien on your property. This means they claim rights to any profits that are made as a result of the sale of your home, even in bankruptcy proceedings. Here's some more bad news, a Federal Tax Lien then gets reported to all credit reporting agencies, which severely damages your credit score. This kind of information on your credit report can make it virtually impossible for you to apply for a car loan, or other forms of open credit.
IV. How Can You Resolve A Federal Tax Lien?
A Federal Tax Lien can have damaging effects on your financial situation. That's why it's critical to resolve your tax liability issues as quickly as possible - before a federal tax lien is issued. Fortunately, we might have some time, due to the procedural processes that must happen before a tax lien is issued. I can't say this enough,"it's critical that you contact my office as quickly as possible so I can help you through the complicated IRS codes and procedures to get you into compliance before you are served with a Federal Tax Lien". If you meet the criteria for a lien removal, I will try to get the IRS to give you a certificate, in accordance with Section 6325, stating that the lien has been removed and the tax debt is satisfied.
One of the most important decisions you make in your lifetime will be the tax debt attorney or tax professional you choose to take on the IRS. That's why I'm going to expose some of common myths about tax debt attorneys and tax professionals. That way you can have a better chance at making the right decision that will affect your life.
MYTH #1: EVERY ATTORNEY/TAX PROFESSIONAL HAS ABOUT THE SAME AMOUNT OF EXPERIENCE AND TRAINING.
This has to be one of the biggest myths today. The fact of the matter is experience and training differs greatly from professional to professional. Some lawyers may have years and years of experience drafting wills, and shuffling papers in real estate transactions or all the tax professional may have done is prepare tax returns. The IRS tax attorney or tax professional you hire to represent you before the IRS should have a "proven" track record of working on cases just like yours and helping people with their IRS tax debt.
Further some tax professionals may be nothing but salesmen. They won't even work on your case. They may just ship your case off to someone you've never met or talked to in another part of the country.
MYTH #2: IF AN IRS TAX ATTORNEY/TAX PROFESSIONAL IS ON TV, HE/SHE MUST BE GOOD.
Of course, this is a false statement. Unfortunately, just because an IRS tax attorney or tax professional appears on TV doesn't make them qualified to handle tax settlement case. Some attorneys and tax professionals who advertise on TV don't even appear on the commercial themselves, but hire actors. Or even worse, some of them pay a national promotional company to run 1-800 # commercials in their market to send them calls.
Most of these are national companies who aren't even located in this area!
Please don't be fooled by those slick commercials. Wouldn't you rather talk to a local WV IRS tax debt attorney helping you. Research these national companies and find out about their practices. If a lawyer or tax professional doesn't have the right tools, skills, or experience that you're looking for, then don't hire that person.
MYTH #3: ALL LAWYERS/TAX PROFESSIONALS ARE SKILLED IN THE ART OF NEGOTIATING.
You guessed it, wrong statement again. Some of the worst negotiators I've ever seen have been lawyers! Find out how long these people have been negotiating in their career.
